Dear Member,
Ref: Confusion about "Written Statement"
We write to clarify your obligations under the Renters’ Rights Act 2025 which came into force on 1 May 2026, specifically in relation to written statements and the required information sheet.
There has been some confusion on this point, so please note the following clear guidance.
For existing tenancies that were already in place before 1 May 2026, you are not required to issue a new written statement where a written tenancy agreement already exists.
Instead, you must provide your tenants with the official government document known as the Renters’ Rights Act Information Sheet 2026. This must be served on all existing tenants by 31 May 2026. The document must be the official version and should not be amended.
For all new tenancies created on or after 1 May 2026, you are required to provide a written statement of terms. In most cases, this requirement is satisfied within your tenancy agreement, provided it includes all prescribed information such as the parties, property, rent, and key terms of the tenancy. There is no requirement to issue a separate standalone document if your agreement is compliant.
If you have a tenancy that is not in writing, you must provide a written statement of terms, as the information sheet alone will not be sufficient in this situation.
You can download the official Information Sheet here:
https://www.gov.uk/government/publications/the-renters-rights-act-information-sheet-2026
We strongly recommend that you ensure service of the Information Sheet is evidenced, either by email or written acknowledgement, to protect your position.
If you require a fully compliant tenancy agreement or written statement, or assistance with service requirements, please contact the advice line.
The new British Landlord Association tenancy is compliant with the Renters Rights Act 2025, and there is no requirement to issue a separate, standalone document.
Kind Regards
