Whether you're using free or paid services, understanding the nuances of data usage is essential. I'm not a lawyer; this is not legal advice, but here's my "layman technologist" take on these vital topics.

  1. Data Usage: Free AI versions often use interaction data to improve models, while paid versions offer more privacy features or promises the more you pay.
  2. API Security: Using API variants of AI models provides an additional layer of security. APIs generally come with stricter data handling policies and more control for you as a "developer" using them, ensuring confidentiality.
  3. Platform Choices: For those with privacy requirements even paid platforms can't make, consider "rolling your own" local AI platforms like AnythingLLM. These setups toy have complete control over and offer you enhanced privacy controls and transparency in how data is or is not used.

In my practice, I do these things to make me feel better (& ethical) about using AI:

  • I read the terms of service/privacy policies of the tools I use, especially if I plan to use them for sensitive or over an extended period.
  • For any tasks involving specific compliance requirements (HIPAA, GDPR, etc.), I explore local AI solutions or invest in paid versions of platforms like ChatGPT Plus or Pro, as they provide greater control over data usage.
  • I provide transparent messages to my clients in emails like these (see bottom of this message) and in other reports or deliverables I provide.
