Kimsey Tried (And Failed) For PA To Take Action Against REC Initiative, Threatened To Take Matters Into His Own Hands
I have obtained a memo marked 'privileged communication,' wherein Auditor Greg Kimsey made a last-minute attempt on January 26th to coerce the Prosecuting Attorney's Office into halting the Restore Election Confidence Initiative (REC) or face potential interference from him.
Kimsey's attempt to persuade the PA's Office that the REC Initiative violated laws and Charter limitations was, as the kids say, weak sauce, to say the least. What followed in the memo was a display of sheer arrogance and entitlement.
Kimsey explicitly stated that if the PA's Office didn't take action against REC, he would take matters into his own hands, despite lacking the authority under the Charter or state law to do so. His words were clear: 'If you do not take action as set forth in the Charter... the county auditor should take action when required.'
Even more concerning is Kimsey's cavalier attitude toward potential legal repercussions, as he acknowledged that his actions could expose the County to legal challenges. He seemingly justifies this by suggesting that a judge would prioritize the initiative's alignment with the Charter over the audacity of an elected official overstepping boundaries.
This behavior from our County Auditor is unacceptable. It reeks of arrogance and a disregard for the fundamental rights of citizens to petition their government. It's imperative that we hold our elected officials accountable and prevent such power abuses from occurring.
Thankfully, following the memo with an urgent request for a response, the PA's office promptly sent me the legal review, which rejected Kimsey's claims. They confirmed that the REC initiative falls within the bounds of local initiative powers as defined by law. Nice try Mr. Kimsey...
Now we understand Kimsey's urgency in amending the Charter to swiftly remove initiatives he opposes, circumventing legal hurdles to do so.
