Auditor Kimsey Misleads The Council To Brush Off Election Concerns
On June 7, 2023, several citizens testified of concerns regarding Clark County elections in an attempt to stop Kimsey from receiving $4.4 million of ARPA money for the elections department. Since the request was coming up before the County Council, this was a good time to elevate problems that Kimsey ignores and refuses to remedy.
I recently submitted a public records request and obtained records that the Auditor sent an email to the Clark County Council on July 24. This email attached a PDF that addressed several of the concerns that were brought up. And as you can see, the Auditor's answers are weak and sometimes quite deceiving.
For example, when addressing the issue of ballot errors in the 2022 election recounts, Mr. Kimsey misleads the Council by stating that ONLY 2 ballots were missed when a total of 16 ballots out of only 11,861 ballots were recounted. This demonstrates an error rate far outside federal standards of 1 in 500,000.
Yet, notice Kimsey's signature on the canvassing board for 16 ballots that were missed. Shockingly, 14 of them from Kent's 2,390 undervotes from Clark County which is a whopping error rate of 1 in 170.
Regarding video cameras so that the public can have full transparency, the auditor states that it's unnecessary since people can become official election observers. However, the CEOs (certified election observers) can't take notes or take photos so if they observe problems it becomes a he-said-she-said situation which makes it almost impossible to inform the public and get remedies. Apparently, the elections department wants to keep the public in a disadvantaged position by denying video surveillance.
The Auditor is intentionally giving the Council false information and minimal answers hoping that he can brush the concerns aside and move forward with keeping things the same and getting millions more for an expansion that will undoubtedly cost the taxpayers more money in overhead and keep the broken system in place.

One of my arguments was that the State's decision to dismiss my HAVA complaint was disproportionate because no harm occurred, and the copy of the complaint was simply a courtesy copy. The State argued that the County was denied the ability to "prepare a response." But the judge pressed the State and AAG Range, the plaintiff's attorney, and she had to admit the truth.
Keeping Track of The Lies the State Has Asserted to Make Questions of Election Problems Go Away
- The State (Deputy Secretary of State Bolerjack) lied about my submitted complaint to have it dismissed by stating that I didn't include my phone number or have the complaint notarized.
- The State (Assistant to the Attorney General Bob Fergusson) lied to the judge that I was improperly challenging the rule hoping to get my Petition of Review thrown out on a technicality.
- Finally, the State (Assistant to the Attorney General) lied to the judge stating that the County Auditor was harmed when in reality he wasn't in any way denied any legal action, or in other words, no harm was done.
