imageDAY 236: UNSOLVED BALLOT BOX ATTACKS

Consider this as they heap awards on themselves… Earlier that year, Kimsey explicitly argued against ballot box cameras, claiming they were unnecessary. Yet experts agree that if a camera had been installed on the first ballot box attacked (Oct 8th), the subsequent attacks on two others weeks later could've been prevented because of the widespread distribution of video images of the attacker's car and possibly of the person responsible (case in point, no attacks followed the second attack that did have images thanks to Multnomah County having a camera on their ballot box).

Know why the ballots burned for hours, causing the destruction of hundreds of ballots instead of just a few? Kimsey delayed first responders' access to the ballot box key and they were forced to wait for Kimsey himself to arrive on the scene.

Or how about that Kimsey deployed untested over-the-counter fire suppression products that weren't designed for ballot boxes but instead were made for small kitchens?

This is classic coverup behavior and a misdirection effort by government officials hoping the public will accept the narrative that Kimsey ought to be praised for his efforts rather than be held responsible for his failures to judiciously protect our election processes.

imagePreliminary Injunction Hearing on OPMA Violations (Anderson v Clark et al.) DELAYED - Files Not Properly Transferred From Skamania County

I showed up on Wednesday (6/18) to argue for the Preliminary Injunction to void the votes of Feb 26 and March 12, but unfortunately, the files from Skamania County didn't show up (BTW, the defendants were responsible of completing the transfer process), even though I got confirmation from the Clark County Clerk that the files had been received... so the Judge put the hearing on hold.

READ CLARK COUNTY TODAY'S ARTICLE ABOUT IT HERE

New hearing Date is tentatively scheduled for July 9, 1:30 PM, the day after the next C-Tran meeting, where the tabled Belkot motion to prevent O&M funding for Light Rail comes back to the C-Tran Board.

As a quick reminder, this case stems from serious violations of the Open Public Meetings Act (OPMA) involving four County Councilors. These Councilors unlawfully failed to notify the public and allow for input before expressing support for language that would open the door to negotiating Light Rail into Clark County.

When Councilor Michelle Belkot—true to her campaign promises—refused to go along with the Light Rail agenda and stood with the constituents who elected her in part to oppose it, Councilor Sue Marshall and Mayor Anne McEnerny-Ogle moved to improperly table the motion. The very next day, the County Council doubled down on OPMA violations by failing to properly notice or allow public comment on two pivotal actions: a vote to remove Belkot from the C-TRAN Board, and a subsequent vote to install Light Rail supporter Sue Fuentes in her place.

Now, a new hearing has been scheduled:

July 9, 2025 at 1:30 PM

Clark County Superior Court

This will be a Preliminary Injunction Hearing, where the judge will evaluate whether the County’s actions were likely unlawful. If so, the Court could nullify the February 26 vote and the two March 12 votes—restoring Councilor Belkot to her rightful seat on the C-TRAN Board.

This case is not just about one Councilor or one issue—it’s about transparency, public trust, and protecting your right to be informed and involved in decisions that shape the future of Clark County. I’ll keep you updated as the case progresses, and I hope to see many of you there in support of open and accountable government.
