Preliminary Injunction Hearing Now Scheduled For September 12, 2025, For 9AM
The original hearing for the Preliminary Injunction was scheduled for May 1, 2025, in Skamania County. However, the Defendants—Councilors Marshall, Yung, Fuentes, and Little—through their Seattle-based attorneys (funded by Clark County taxpayers), successfully obtained a change of venue to Clark County.
Once reassigned, the case was scheduled before Judge Vanderwood for June 18, but a transfer error forced a reschedule to July 9. Then, late in the day of July 7, Judge Vanderwood abruptly recused himself—largely because he was simultaneously lobbying the Council to support a Charter amendment that would eliminate the Clerk as an elected position.
The case has since been reassigned and is now set to be heard by Judge Banfield on September 12, 2025.
