VICTORY: WinCo Reverses Course To Avoid A Trial
Late last week, WinCo contacted me that they have second thoughts about going to trial and wanted to go back to an original plan for an agreed stipulation, something that I was willing to do back in April of this year but WinCo changed, without informing me, and decided to continue the lawfare to trial.
Was it the judge's comments in the Motion To Dismiss hearing where he expressed doubt about WinCo's chances of proving the facts of the case? Was it that there was information in discovery that they'd have to hand over and they didn't want that to come out to the public? Or was it the fact that WinCo was hoping to coerce me into handing over information that is protected by the 1st amendment and past court decisions protecting political activities and speech? Or maybe it was that I was hours away from switching to a high-dollar Pudget Sound attorney that would surely blow WinCo's case apart? I'm not sure, but I'm very grateful to everyone who supported me through this lawfare and stood by me. It was truly grueling for me and pulled me away from very important efforts that I was planning and needed to focus on for this week's election. Was this the enemy's plan to keep me off the battlefield more? Even though it was tempting to want to continue to expose WinCo's accusations as false and completely exonerate my name and reputation, I prayed and decided it was best to resolve so I could move on to more important issues. As of now, both WinCo and I have signed a stipulation that reiterates that WinCo is not a public forum space, something I've agreed with all along, and that I maintain my innocence in the case.

WATCH: As I Crash The "Vigil" To Inform People Of Auditor Kimsey's Failures
Greg Kimsey attempted to use a Saturday vigil to divert attention from his failures as Auditor to protect and ensure the integrity of ballots during the election. Despite requests from citizens and myself to implement camera surveillance at ballot boxes, Kimsey resisted and failed to deploy cameras across all ballot drop boxes. The larger issue here is that ballot boxes without monitoring break the chain of custody, and the truth is that there is no standardized “chain of custody” for ballots in Washington State or Clark County. While there are procedures, they can change easily and lack the strength of codified RCWs.
Kimsey was more focused on opposing the Restore Election Confidence initiative and pushing his Charter Amendment 18, which aims to limit the initiative process and potentially prevent citizens from improving election security, than preparing and dealing with the real challenges of the upcoming Election Day.
Moreover, Kimsey was unprepared for the Election Day demand at the Elections Department office, where long lines formed, with many voters waiting hours to receive their ballots—lines that extended past the 8 PM cutoff. Although the weather was favorable, Kimsey's lack of preparation resulted in voter suppression, as some people likely gave up after being unable to wait for several hours.
Election Day Ballots Swings The Fate Of Charter Amendment #18 (Initiatives)
After the initial returns, it appeared that both of Kimsey’s Charter Amendments would pass. However, following the second batch of returns, Amendment #18 still lagged behind by over 1,400 votes. Thursday’s results, covering 22,000 of the 62,000 remaining ballots, showed a dramatic turnaround. Instead of the previous 1,400+ vote lead against it, Charter Amendment #18 is now being rejected by 19 votes.
Let's pray for a close victory so a mandatory recount happens as well as defeating Kimsey's attempt to transfer more power and control away from the people regarding initiatives.

Initially, it looked like Brad Benton might lose his race for the 18th LD State Senate. But with Election Day ballots now being counted and reported, Brad is only down by only 354 votes and will most likely take the lead. However, he needs your help to cure ballots in order to maintain his advantage, as Democrats will likely begin curing ballots to chip away at any lead he gains in the coming days.
Some other races are close too (Kent, Steube & Ley) so there's plenty of work to be done and your help curing ballots can make a difference.

ICYMI: Kimsey Pivots: Sends Media Out To Smear Firmly Planted Ballot Box as "fake" and "unofficial" & Blames County Council For Not Funding Cameras
Greg Kimsey is clearly in damage-control mode. An unprecedented attack on our elections occurred Monday morning, resulting in close to 500 ballots being destroyed in Clark County, compared to just minor damage in Portland where only a couple of ballots were affected. Why the stark difference? Likely because Kimsey neglected to ensure that fire suppression systems were operational and resisted calls to install cameras at all county ballot boxes.
Last May, Kimsey argued that the expense of cameras was too high, claiming there was no need since Clark County hadn’t seen an incident in 20 years. Yet now he’s telling people he never opposed cameras, shifting blame to the County Council for not funding them. Just a few days ago, on the Lars Larson show, he mentioned they “looked into cameras,” but dismissed the idea as too costly.
Now, he’s deflecting responsibility, suggesting the Council should have funded a plan... that he never submitted. Someone should remind Mr. Kimsey that, as Auditor, he is responsible for ensuring safe and secure election processes. Without a submitted plan, essential improvements simply don’t happen.
This situation is exposing Kimsey’s lack of leadership and accountability. Crises often reveal true character, and rather than taking responsibility, he’s attempting to deflect blame—going so far as to criticize groups like Firmly Planted Action, who are legally collecting ballots in a manner arguably safer and more secure than the county’s official ballot boxes. It’s disappointing but, sadly, not surprising.

Clark County has actually made Portland look better. Thanks to Auditor Greg Kimsey's actions to block cameras at all ballot boxes, even though he was given access to millions of Covid dollars, decided to not provide cameras at ballot boxes. Not only this, but Kimsey wrote just a few months ago that cameras aren't needed in Clark County because, "People respect the elections process, and over the past 20 years, there has not been a single incident of significant vandalism to Clark County’s ballot drop boxes."

BREAKING UPDATE: Reliable sources confirm that ALL THREE ballot boxes are connected because of "Free Gaza" messages on all three devices. The first incident happened on October 8th, just a few blocks away from the Elections office. The only reason the vehicle has been identified is because Portland has cameras and Clark County does not. It's becoming clearer, if Kimsey hadn't fought against installing cameras, authorities would most likely have enough info from the first event to prevent this week's attacks.
