  • Be there no later than 1:20PM, you’ll need to go through security so give yourself some extra time. Even earlier would be good to account for 75 people!
  • No response or comments from the gallery will be permitted. This will be a respectful presence statement of support… that the public is indeed watching. Any bad behavior will be swiftly dealt with by the judge and will reflect poorly on the case. 


SUMMARY OF LATEST DEVELOPMENTS OF THE COMPLAINT

On Thursday (July 20th) I filed the final brief of the election complaint which was a rebuttal to the State's response to my original petition of review. To recap, after the 2020 election two recounts were performed which revealed an error rate of 1 out of 742 ballots were not counted at all. Federal standards are 1 error out of 500,000 is allowed (also the Feds set a standard of 1 out of 10,000,000 as the goal). As a result, I filed a HAVA complaint to the Washington Secretary of State, who delegated it to the Deputy Secretary of State, who wrongfully dismissed the complaint. In so doing, the Deputy Secretary of State, Randy Bolerjack, made up issues about my filing that didn't exist in order to bolster his dismissal decision. The Attorney General's office is acting as the State's defense and sent an 8-page response on June 30th with the general response of trying to get my petition thrown out on a technicality (that didn't really happen) that I'm challenging the rule and not Mr. Bolerjack's decision and that kind of appeal should go through Thurston County Superior Court (where I'd have zero point zero chance at getting a fair hearing). It's a desperate response from desperate people who are supposed to be working hard to make sure our elections are top-notch but who spend their time (and our tax dollars) defending our broken elections systems.


On July 20th I filed a 17-page rebuttal to their 8-page response and I took to task their response and made strong arguments why Mr. Bolerjack's decision was unconstitutional, arbitrary, and capricious.


Here are the issues that I covered in the rebuttal:

1. Mr. Anderson’s petition challenges Mr.Bolerjack’s action, not the rule. Mr.Bolerjack, on behalf of the Secretary of State, had complete discretion regarding Mr. Anderson’s HAVA complaint and misapplied WAC as stated in Mr. Anderson’s Brief of Support.

2.     Violation of Constitutional Rights and Undermining HAVA's Purpose: Arbitrary Dismissal and Impediment to Filing a Complaint. Mr. Bolerjack has sworn an oath to protect and uphold the US Constitution and failed to act in accordance with his oath by ultimately denying Mr. Anderson the constitutionally protected right to pursue a resolution of a HAVA complaint.

3.     Use of State-Provided Form: Compliance and Lack of Instruction. The deficiency within a state-provided form should not be allowed by the state as a means of dismissal.

4.     No Harm Caused: Disproportionality of Dismissal. The principle of proportionality is a bedrock of our judicial system and Mr. Bolerjack’s action to dismiss was disproportionate because no harm occurred to the respondent Mr. Kimsey, the Clark County Auditor.

5.     False Statements by Mr. Bolerjack: Disregard for Accuracy and Impact on Complaint Dismissal. It's an undisputed fact that Mr. Bolerjack’s decision was based mostly on false characterizations of Mr. Anderson’s complaint which brings into serious doubt the integrity of his decision to dismiss.

I've been tirelessly working on this response and since I'm not an attorney I'm doing my own research and building the best response possible. I have been consulting legal resources but what I've discovered is that our judicial system and all that supports, like the Bar associations, have made election issues so radioactive that very few attorneys will get involved because of the backlash that will undoubtedly be unleashed on them professionally. It is akin to what our legal system did back in the Jim Crow days. Back then, when courts were firmly segregated and arms of segregation, any attorneys willing to defend civil rights were shunned and similar tactics were used to keep the accepted idealogy in place. Obviously, election integrity topics haven't gotten to the point of what we saw in the Jim Crow era (brought to you by the Democrat party) but the similarities are growing.
