I. WHAT YOU MUST KNOW

USA: $252M BIS Hammer Blow

We discussed this in The Export Control & Sanctions Watch, Edition 07-2026 - Week 08-2025 because a $252 million BIS penalty for semiconductor exports to China signals that "creative routing" will now be priced at twice the transaction value. This enforcement action transforms compliance from a background hum into a balance sheet event that requires immediate executive filtration.

GERMANY: German ATLAS Shutdown

We discussed this in The Customs Watch EU, Edition 07 - Week 08/2026 because the ATLAS 10.2 "hard" cut-over on 28 February is a digital guillotine that will auto-reject any declaration missing the upgrade. Failing to migrate means cargo will be left rotting at the border, creating a definitive "computer says no" moment for unprepared supply chains.

UK: CBAM’s Carbon Clobbering

We discussed this in The Customs Watch UK, Edition 7 - Week 08/2026 because the UK CBAM consultation closes on 24 March, marking the final opportunity to influence the administrative costs of this massive new carbon tax. This concerns any company importing aluminium, cement, or steel, as the draft rules for registration, returns, and record-keeping will define your tax liability from 1 January 2027.

USA: First Sale Under Fire

We discussed this in The Customs Watch USA, Edition 7 - Week 08/2026 because a draft Senate bill is now seeking to eliminate the "First Sale for Export" valuation method. This tool has protected millions in margins for over a decade by allowing duties to be calculated on the lower, initial factory price rather than the final sale value. If this legislation passes, landed cost models across entire industries could unwind in a single cycle, triggering an immediate and permanent spike in duty liability for high-volume importers.

II. HOW TO REDUCE YOUR RISK

SDN Shockwave Expansion

  • What It Means: Sudden expansion of OFAC SDN lists targeting terrorism and Russia-related networks turns routine screening into a high-stakes financial firewall.
  • Who Is Impacted: Finance & Banking Teams are most affected as transaction screening must be real-time to prevent frozen funds and counterparty exposure.
  • What You Can Do: Audit your screening software immediately to ensure all new designations are integrated into daily payment and onboarding workflows.
  • What to Watch Out For: Expect increased "secondary sanction" pressure on third-country intermediaries attempting "creative routing" to bypass US restrictions.

III. HOW TO KEEP MORE OF YOUR MONEY

USA: India Duty Recovery Opportunity

  • What It Means: An Executive Order has terminated the additional 25% duty on products from India (formerly under HTS headings 9903.01.84–9903.01.89) effective February 7, 2026. This isn't just a future saving; it may event create an immediate path to reclaim overpaid duties.
  • Who Is Impacted: Finance and Duty Accounting teams should prioritize this to identify eligible overpayments and reconcile duty accruals. Trade Compliance must ensure brokers stop using the terminated codes to prevent misdeclarations.
  • What You Can Do: Conduct a 7-day retrospective audit of all India-origin entries filed on or after February 7 to quantify potential refunds and validate that no residual 25% surcharge was applied.
  • What to Watch Out For: The order includes a "monitoring trigger"—if India resumes certain trade activities (like Russian oil sourcing), the 25% duty could be reimposed with little notice.

IV. VIDEO OF THE WEEK

We recommend you watch "EUDR 2027 Explained: Why Missing GPS Data Can Shut Down Your EU Shipments"

Unlock the truth behind EU Deforestation Regulation (EUDR) 2027 compliance and learn exactly why missing GPS and traceability data can halt your shipments at EU borders. In this video, we break down how the new EU customs enforcement mechanisms work, what customs authorities are checking, and practical steps you MUST take before exporting agricultural and forest-linked commodities into the European Union.

This is essential viewing for customs managers, compliance officers, logistics professionals, and export/import teams preparing for EUDR enforcement starting in 2027.

V. TRADE DOCUMENT OF THE WEEK

Every week, we are pulling one high-value asset from your Knowledge Hub, our searchable repository that PRO subscribers bookmark and return to for documents that are difficult to find easily elsewhere.

This week, we have selected:The "Reasonable Care" document under U.S. Customs and Border Protection (CBP). It outlines the legal obligation of importers to ensure that all information provided to CBP is accurate, complete, and in compliance with U.S. laws. Established by the Customs Modernization Act of 1993 (Mod Act), this doctrine shifted the burden of responsibility for compliance from CBP to the importer of record. Download it now.
