before signing the dotted lines…
You need to work on your relationship with your Co-founder(s)
You cannot correct the defects in your relationship with your Co-founders by simply signing a Co-founders or Shareholders Agreement.
And when the relationship dynamics are bad, no amount of agreement can make things better
Do your homework and be sure that your would-be Co-founder is someone that you can trust enough to actually "live with" for a long time.
If your Co-founder has a character defect, you should seriously consider that before signing any Agreement.
If you don't trust them enough to do business with them why bother?
An Agreement won't do the magic.
And when it comes to trust, I believe that you shouldn’t trust too much someone who has nothing to lose but hurting you...
This is a very profound statement you shouldn’t take for granted.
So…
Do your homework on the person…
then insist on documentation of your Agreement…
Then you can go ahead and Co-found a business.
...
This is how to get started on the right path.
