Hello , today, I want to quickly share with you some answers to the frequently asked questions that I get on Business registration.

1. What are the options that I have when registering my business?


Ans. You can register your business either as a business name or as a limited liability Company.


While a business name is just a simple venture with no serious legal power, a company Is an independent legal entity that has lots of rights and responsibilities just like an actual person.



2. How do I make sure that the name I do business with is protected?


Ans. You have to first register the business first with the Corporate Affairs Commission and then with any other relevant authority depending on the nature of your business.


You might equally go a step further and trademark the name for stronger and wider protection.



3. What happens if someone else is already using my business name?


Ans. If this is the case, you would have no choice but to choose a different and unique name for your business.


Business registration is on a first come first serve basis.


This is what makes it legally dangerous for you to start using a name you haven't registered.


While getting popular with the name, someone else might go behind you to register it.


And when that happens, no matter how popular you have become with the name, you have legally lost it to someone else.


4. How do I check if my proposed name is available?


Ans. You can simply use the Public Search button on the CAC website to check if your proposed name is available right now.


The public search will reveal whether someone is already using that name including other similar names.


The name, address, RC number, and date of registration of the company will be revealed as well.


5. Can I Upgrade my business name in the future?


Ans. Yes, you can always upgrade your business name anytime in the future to an Ltd Liability Company.


However, this might be more expensive than registering a company form the beginning.


This is why i tell people not to allow cost stop them from getting the legal aspect of things in their businesses right from the beginning.




6. How long is my CAC certificate valid for?


Ans. The Registration Certificate does not expire. As long as you are in business your Certificate remains valid.
